Privacy Policy
1. Controller
EverFlow Experience — Juan Rodrigo Fernandez (sole proprietorship)
Glockenblumenstraße 29, 80935 Munich, Germany
Email: info@everflowexperience.com · Phone: +49 175 9505075
No data protection officer has been appointed, as the business is not required to appoint one. Please send any privacy request to the email address above.
2. What we do and whose data we process
We design and arrange tailor-made alpine experiences: private ski and snowboard coaching, accommodation in hotels and chalets we book for you, transfers, guiding and related services. In doing so we process personal data of website visitors, people who enquire with us, and guests who travel with us.
3. This website
3.1 Hosting and server logs
The website is hosted on GitHub Pages, a service of GitHub, Inc., 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA (a Microsoft company). When you open a page, your browser connects to GitHub's servers, and GitHub logs the visitor's IP address for security purposes. GitHub processes this data on our behalf and on its own responsibility as a hosting provider. Legal basis: our legitimate interest in a secure and reliable website (Art. 6(1)(f) GDPR). GitHub is certified under the EU-U.S. Data Privacy Framework and additionally relies on the EU Standard Contractual Clauses for international transfers.
Our domain is managed by Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA (DNS and email routing, see section 4). Cloudflare is certified under the EU-U.S. Data Privacy Framework.
3.2 No cookies, no tracking
This website does not set cookies, does not use analytics or marketing tools (no Google Analytics, no Meta pixel) and does not embed social-media plug-ins. Fonts and scripts are stored on our own web space, so no data is sent to font or script providers. For this reason no cookie banner is shown.
3.3 Interactive map (only after you click)
The "Our operational reach" map is not loaded automatically. It appears only after you click "Show map". When you do, map tiles are requested from the OpenStreetMap Foundation (St John's Innovation Centre, Cowley Road, Cambridge CB4 0WS, United Kingdom). The OpenStreetMap Foundation then receives your IP address, browser type and the page address; its servers are located in the EU and the United Kingdom, which is covered by the European Commission's adequacy decision. Retention is governed by the OpenStreetMap Foundation's privacy policy (osmfoundation.org/wiki/Privacy_Policy). Legal basis: your consent given by clicking the button (Art. 6(1)(a) GDPR). You can simply not load the map; the destinations are also listed as text.
3.4 Enquiry form and booking request
The forms on this website have no server behind them. When you click "Send", the text you entered is handed to your own email program (mailto link) or to WhatsApp on your device, and the message is sent from there. Nothing is stored on the website itself. We receive and process your enquiry as an email or WhatsApp message (sections 4 and 5).
3.5 Links to Instagram, WhatsApp and partner websites
The Instagram, WhatsApp and partner links are plain links. No data is transferred to these providers until you click a link; from then on the privacy policy of the respective provider applies. If you use our Instagram profile, Meta Platforms Ireland Ltd. is responsible for the processing on its platform; we are jointly responsible only for content we publish and messages we answer there.
4. Email
Emails to info@everflowexperience.com are routed through Cloudflare Email Routing to our mailbox, which is operated by Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, with Google LLC, USA). Both providers are certified under the EU-U.S. Data Privacy Framework. We process the content of your message and your contact details to answer you and to prepare an offer (Art. 6(1)(b) GDPR — steps prior to a contract).
5. WhatsApp
You can contact us via WhatsApp (WhatsApp Ireland Limited for users in the EU; Meta Platforms, Inc., USA, certified under the EU-U.S. Data Privacy Framework). WhatsApp processes your phone number, profile data and metadata according to its own privacy policy, and may transfer data to the United States. We use WhatsApp to answer your enquiry and to coordinate a trip quickly (Art. 6(1)(b) GDPR); by contacting us there first you agree to this channel (Art. 6(1)(a) GDPR). If you would rather not involve Meta, write to us by email instead — we treat both channels equally.
6. Data we process when you enquire, book and travel
| Activity | Data | Purpose | Legal basis |
|---|---|---|---|
| Enquiry (email / WhatsApp / form) | Name, email, phone, dates, group, destination, message | Answer you, prepare a proposal | Art. 6(1)(b) — steps before a contract |
| Booking and trip organisation | Names of all guests, contact details, age where needed (e.g. children's lessons), ability level, pick-up location, travel dates, invoice data | Deliver the trip, brief partners, invoice | Art. 6(1)(b) and (c) (tax and record-keeping duties) |
| Hotels, transfers, aviation | Passport / ID details and nationality — only if the partner or the law requires them | Check-in, statutory guest registration | Art. 6(1)(b) and (c) |
| Safety on the mountain | Injuries or medical notes you choose to give us, emergency contact | Safe delivery of lessons and guiding | Explicit consent Art. 9(2)(a); vital interests Art. 9(2)(c) |
| Dining | Allergies and intolerances | Brief restaurants and chalets | Consent Art. 6(1)(a) / Art. 9(2)(a) |
| Photos and video | Images taken during the trip | Memories for you; publication on our website or social media only with your consent | Consent Art. 6(1)(a) |
We currently send no newsletter. Should we introduce one, it will be based on your consent with an unsubscribe link in every mailing.
7. Who receives your data
Only as far as it is needed for your specific trip: the hotels, chalets and restaurants we book for you; certified ski and snowboard instructors, mountain guides and local partner schools in Germany, Austria, Switzerland, Italy and France; transfer, helicopter and aviation partners; our bank (incoming payments); our tax advisor and accountant; insurers in the event of a claim; and the technical providers named above (GitHub, Cloudflare, Google, WhatsApp / Meta, OpenStreetMap Foundation). Each partner receives only the data needed for its part of the trip. Hotels and other providers that deliver a part of your trip process your data as independent controllers under their own privacy policies.
8. Transfers outside the EU
Some of the technical providers named above (GitHub, Cloudflare, Google, Meta / WhatsApp) process data in the United States. Where a provider is certified under the EU-U.S. Data Privacy Framework we rely on the European Commission's adequacy decision; otherwise on the EU Standard Contractual Clauses. The map provider, the OpenStreetMap Foundation, is based in the United Kingdom, which is covered by an EU adequacy decision. Partners in Switzerland are covered by the EU adequacy decision for Switzerland. Trips outside the EU are arranged only at your request (Art. 49(1)(b) GDPR).
9. How long we keep data
- Enquiries that do not become a booking: normally deleted after 12 months.
- Contracts, invoices and tax-relevant documents: statutory retention in Germany, generally 8 to 10 years.
- Trip organisation data: until the trip is completed plus the statutory limitation and evidence periods.
- WhatsApp chats: for as long as the trip is being planned; afterwards deleted or archived like the booking.
- Photos and video: until you withdraw your consent.
- Server logs: handled by GitHub in accordance with its privacy statement; map logs at the OpenStreetMap Foundation: see its privacy policy.
10. Children
Family trips: we accept data of minors only from a parent or legal guardian and only to organise the trip. We do not market to children.
11. Your rights
You have the right to access your data, to rectification, erasure and restriction of processing, to data portability, to object to processing based on legitimate interests, and to withdraw any consent with effect for the future. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal. To exercise your rights, write to info@everflowexperience.com.
You may also lodge a complaint with a supervisory authority. The authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany, www.lda.bayern.de — or the authority of the EU country where you live or work.
12. What you must provide
To organise a trip we need the contact and travel details required to fulfil the contract; without them we cannot arrange the trip. Passport, health and dietary information is requested only when a specific part of the itinerary requires it; providing it is voluntary, but without it that part (hotel check-in, helicopter transfer, restaurant briefing) may not be possible.
13. Automated decisions
We do not use profiling or automated decision-making that produces legal or similarly significant effects.
14. Changes
We update this policy when our services, providers or purposes change. The version published on this website applies. The German version below is written for German supervisory practice; if the two ever differ on a formal point, we will correct them so that they match.

Data Privacy Framework zertifiziert.
3.2 Keine Cookies, kein Tracking
6. Daten bei Anfrage, Buchung und Reise

8. Übermittlung in Drittländer
